1. Scope of Agreement

This agreement governs the access, purchase, and use of digital products (“Downloads”) offered by Westlink Realty Group, including but not limited to:

  • Landlord email templates

  • Rent increase kits

  • Lease renewal packs

  • Compliance guides and checklists

  • Subscription resources and advisory materials

These materials are provided for educational and administrative guidance to landlords and property owners within New South Wales.


2. No Agency Relationship

Purchase or use of any downloadable resource does not create an agency, management, or fiduciary relationship between the buyer and Westlink Realty Group.
Landlords remain fully responsible for compliance with:

  • The Residential Tenancies Act 2010 (NSW)

  • The Property and Stock Agents Act 2002 (NSW)

  • Fair Trading NSW guidelines

Westlink Realty Group provides templates and advice for informational purposes only.


3. Intellectual Property

All materials remain the intellectual property of Westlink Realty Group.
Buyers are granted a single non-transferable licence for personal or business use. Redistribution, resale, or reproduction without prior written consent is prohibited under the Copyright Act 1968 (Cth).


4. Professional and Legal Disclaimer

While Westlink Realty Group ensures all materials reflect current NSW legislation and industry best practice:

  • The downloads do not substitute professional legal advice.

  • Users must verify the content’s suitability for their own property circumstances.

  • The information is general in nature and should not be relied upon as legal, financial, or taxation advice.

If uncertain, users are encouraged to seek independent legal or financial advice before acting.


5. Limitation of Liability

To the fullest extent permitted by law:

  • Westlink Realty Group disclaims all liability for any loss, damage, or claim arising from the use or misuse of downloaded materials.

  • Liability (if any) is limited to the amount paid for the product.

  • Users indemnify the Agency and its licensees against any costs or claims arising from actions taken based on these resources.

This clause mirrors the indemnity provisions in your management agreement (see Clause 14, Indemnity

 ), ensuring consistency with your licensed obligations.


6. Refunds and Cancellations

Due to the digital nature of the products:

  • Refunds are only available if the file is defective or misrepresented.

  • Refund requests must be made in writing within 7 days of purchase.

  • Subscriptions or bundled services can be cancelled anytime but will not be refunded for the remaining term.


7. Compliance With Fair Trading and Consumer Law

This agreement complies with the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) and the Property and Stock Agents Regulation 2022 (NSW).
Westlink Realty Group maintains accurate, transparent pricing and terms of service to ensure full compliance with Fair Trading NSW requirements.


8. Privacy and Data Use

Personal information collected through purchase or registration is handled in accordance with the Privacy Act 1988 (Cth).
Westlink Realty Group may use customer details to:

  • Process transactions

  • Send educational updates or promotional material

  • Maintain compliance records

Users can unsubscribe or request data deletion at any time.


9. Governing Law

This agreement is governed by the laws of New South Wales, Australia, and any disputes shall be resolved under NSW jurisdiction.


10. Acceptance

By downloading, purchasing, or using any Westlink Realty Group digital product, you acknowledge that you have read, understood, and agree to this Service Agreement.
